Couldn't you sell your 'time investment', then transfer the char the legal way?

Close -- sell the right to pay X isk for the character transfer. CCP can't prohibit you from selling your effort (in performing the transfer). Conversely, they are under no obligation to allow anyone (seller or buyer) to continue to subscribe to the game, and all in-game items (including characters) belong to CCP which they may or may not permit you to access.
Summary: CCP can't bring legal action to stop such a "sale", but they are under no obligation to permit the fruits of the sale to be utilized.

I just saw a very clever sale. The guy was asking for a "donation" with the person giving him the highest donation receiving the character. Quite clever, in my opinion. |

No legal action, certainly. Ebay has previously pulled used software and other sales at the request of publishers and copyright owners, even if there really isn't any legal standing for the complaining party to prevent the person from reselling their stuff.
Chances are, if CCP complainted to ebay, they would pull the auctions.

there was one a few months back where the seller was actually selling a picture his daughter drew, which came with a free high spec eve online char + assets, the auction was well thoughtup, went into alot of detail able the picture and the "free" eve 0 char they would also receive, i thought it was pretty clever and no idea how the EULA would handle it |
