I see no problem with this policy, as long as the miners are truly being protected and getting something for their work. I'd imagine that when mining, not much protection is needed deep in CA space. Most enemies are found near the borders. Not that any CA PvPers can be found deep in CA (or in the area at all) either.
CA PvPers have been in PA and FA for a month. Tell me, what are the miners getting for their money? They get to be part of CA? Do they get a T-shirt too?
I can go in CA right now (yes, it's true, place is deserted) and mine and refine just like the CA miners can. Guess what, we're both paying the fee, getting nothing in return really, except that I'm a sworn enemy. Hmmm...

You get more minerals from NPC hunting that you do mining. What CA should really do is trim the fat, get rid of some dead weight, axe the miners, put them on the KOS list. Unless the mining corps are actually physically providing battleships. I don't know. Until now I assumed that VOTF was doing all the mining.
