I haven't accepted the b/o yet though. I wouldn't pay for my groceries before i went into the shop. I would pay for it when i got to the till. Its a question, I'm not trying to scam the man

Seems to me that you are trying to scam, otherwise you wouldn't be trying to worm out of the sale. You stated you would "Accept" 4.5B B/O so why would he need to contact you, to see if you had changed your mind, wow I need to stop shopping online and call each shop to see if its ok to send them the money to buy there merchandise.

These are the rules - Agreements on the forums or in game, or winning an auction does not guarantee a character will be transferred to you. The seller may choose to renege on a deal at any time, prior to the transaction being completed

So if you have now decided not to sell, send him the isk back. I cannot beleive you are even asking if it is a gift, the only reason for this question is to try and scam the toon that sent it. The way I see it is this...
1. Send him the toon as he accepted your B/O price
2. Return his isk if you have now decided not to sell.

GM or ccp doesnt really have to look at this
the rules state no scamming allowed, you cant keep the isk if you decide not to transfer the char , if you decide not to keep
the char you must reinburse the isk inmediatelly or face a game ban of your char/s
renaming the scam a gift still makes it a scam so good luck with trying
so NO you cant call it a gift because you got cold feet about the sell , if he sent the isk for what you called the buy out , you must reinburse it or
transfer the char over to his account

i agree you must be a complete idiot he clearly stated isk sent with his account info that should tell you right away that it was not a gift so you must be a scammer or other wise give him his isk back or transfer the toon

Technically because you havent accepted the buyout in writing it is a gift....
But ccp will not let it stand they have removed isk from people accounts and given it back in situations like this in the past ccp will not let this happen here.
I would either give isk back or send the char gm's will get involved if you dont they will warn you and obviuosly remove isk and send it back to the owner.
But no as of yet you havent scammed anyone just ingore the trolls techically you havent done anything wrong yet its just your choice but either way no you cant have the 4.5 billion for free lol

Wow this thread turned into a **** storm. I'm pretty sure the owner of the character has the right to not sell the character for w/e reason but you can't keep the isk  .
There's no reason for this to be a big deal. Just return the isk if you don't wanna sell it.
