ChipMo's Civil Court of New Providence
Got a dispute? Need an impartial venue and arbitrator to oversee its resolution? Why not give the CCCNP a call.
The CCCNP is an independent court which wields only the power invested in it by the parties of the dispute. We can currently offer Civil Courts for diplomatic resolutions, trade and resource disputes, thefts, aggression resolution and any number of minor disputes you and your adversaries may wish to settle out side of violence.
How does it work?
If both parties involved in a common dispute agree to abide by the ruling of the CCCNP we will set a court date. Ideally these will be held in space where each party is represented by themselves, proxy, or lawyer. Each party is also encouraged to bring along a sizeable group of supporters to view and validate the proceedings.
Both parties will convene at the agreed time and place, virtual venues can be accommodated but we at CCCNP believe conflicts are best resolved face to face and we strongly recommend making use of our court venues in space. Once in position, court will commence and both parties are given opportunity to present their case and respond to any specific issues with what the counter-party claims. Evidence such as pilot logs, killmails, and witness testimony is all welcome and will be viewed objectively.
The court will recess while the verdict resolutions are deliberated. Once reconvened the verdict and blueprint for resolution will be presented to the parties present. We can never guarantee our verdict will be accepted, however by signing up to use our service it is our sincerest hope that people respect our verdicts (else why hire us in the first place!). We at CCCNP do accept that there may be situations where the resolution proposed is unacceptable to either party involved. In such cases the defendants and their supporters may attempt a resolution through arms. Be warned though the courts automated weaponry will be trained upon those who employ acts of aggression first. Court employees will not fire upon either party unless directly fired upon.
How much does it cost?
Preliminary cases will be heard at a cost of 3m ISK per hour in session. You may hire legal advisor's, lawyers, security as you see fit.

So it's little more than a talking shop then as a court without the power to enforce its judgements is meaningless. Perhaps calling this a non-binding arbitration service would have been more accurate?

Making things explode is never free. It can often turn out to be rather expensive, buying an adiquate ship, drones, ammunition, nanite paste, boosters and so on. These things can mount up rather quickly and I believe in comparison the court fees are exceptionally reasonable.

As stated in the OP the court holds only the power invested in it by the disputing parties. This is as much or as little as they see fit. If it is treated as a joke it will become one, if people make honest use of the service it will be a great asset for the region.

I doubt this will happen but I have to ask, will Star Fraction keep it's own political agenda out of each and every case and remain neutral?
If yes then I'll have to admit this could be a valuable service to the Providence community and I welcome it despite my dislike for Star Fraction.

Would be rather counter-productive of ChipMo to do otherwise. The objective here is to provide a trustworthy service in the form of arbitration of disputes in the New Providence, which cannot be accomplished by anything other than impartiality.

Now this, I have to break my own policy and respond to.
Formal, neutral mediation and/or arbitration? Among capsuleers?
This is a fine idea. If we are ever to be a civilization, ourselves, we will need this sort of thing, and I admit it raises the Fraction greatly in my estimation that you came up with it.
Formally toothless it may be, but then so are all declarations from international courts (being as they mediate between entities interacting in a state of, heh, anarchy). Play your part as impartial arbiters well, and you'll likely find your court's decisions carrying some genuine weight.
This could be very interesting. Well played.

Edited by: Nachshon on 29/04/2010 20:49:55 I must admit, I find it difficult to believe that a court attached to the Star Fraction would be capable of rendering impartial verdicts in all cases. The Star Fraction have made both friends and enemies.
Even if they can remain impartial, their anarchist ideology complicates things. How would they resolve a territorial dispute, when they believe that none have the right to hold territory? Would they be able to set aside their personal ideologies?
Let me offer a hypothetical case. Alpha is a territory-holding alliance. Bravo is an industrial alliance. Alpha and Bravo signed a contract allowing Bravo to establish a presence in Alphan territory, provided they made no effort to acquire sovereignty over Alphan territory. Recently, Bravo constructed a station in Alphan territory. Alpha claims that the contract has been breached. Bravo claims that a single station is no threat to sovereignty. Both alliances have powerful allies, and a war would be bad for everyone concerned.

There is at least one historical reference to an alliance of significance calling itself Cookies Cake Cream and Pie (coincidentally, CCCP) many years ago. This record indicates they were eventually asked to change the monicker by a nameless externality due to that pattern of letters. I have no personal experience with these events, and cannot say if the records are accurate or not. However, there does seem to be some possibility that if, during the pursuit of this innovative venture, you intend to send "official communications on behalf of CCCNP," there may be some risk of an alien intervention.

August? Not ... very.
Edit again:
Also, considering that your court's orders are unenforced, should the figure on your seal really be carrying a sword? It signifies the coercive power of a nation-state, after all.
Thank you for the endorsement & kind words... The name, I confess is not one which I spent much time deliberating on, ha, perhaps it will turn out to be a mistake. It does reflect me though - what you see is what you get, no flashy branding or false flags.. simple honest and straight forward. If a little cheesy, *ChipMo chuckles.
I have spent my time developing this model of court process, how things will operate and designing / initiating the various channels and venues. I think the acronym CCCNP will probably take over from the rather long winded name in the OP.
As to the logo, that's an interesting interpenetration of it. Not one I had intended, the woman is supposed to represent a client, and their options are reflected by what she carries. On the one hand there is the way of violence, symbolised by the sword, on the other hand there is the way of compromise & diplomacy, as reflected by the "Scales of Justice". I kept this option in the foreground as that is what we promote, but we shouldn't completely detach ourselves from the option of violence. I feel our clients should keep a hold of it... ah listen to me rabbit on like a 1st year Art Student, ha!
Connotations of Nation State power is certainly not something I wish to promote, and well, not at all relevant to what we're trying to do here. Perhaps the logo, name, will change over time. For the moment though, I will go with what I have. I would really like to spend my up coming time on a case before I look at re-branding this early on.
I would like to thank Koronakesh, and Jasmine for responding to those issues raised and they are both entirely correct. I have a strict policy of not discussing hypothetical, or imaginary cases, they are futile discussions that lead no where and serve no purpose. I appreciate until I build up a portfolio it will be hard people to take a chance on my impartiality and judgment but that is how these things work. We have to start somewhere, for me it will be a case, not some hypothetical musings. With regard to my Star Fraction relationship, they are two different worlds, my politics and wars will be left at the door to the court room. It cannot work any other way.

Equity aids the vigilant, or those who snooze loose
There are those who may argue that the moral obligation to obey the law is its principle strength, but not me. Such a position has an obvious flaw, and is probably upon examination better reformulated as, in many political communities, some citizens have, at least, claimable belief-dependent prima facie obligations to their fellow citizens to obey at least 'some' state-made laws. The anarchist only rejects law made or enforced by the state. Plausible anarchist arguments, at any rate, do not lead to the conclusion that social chaos is desirable, that the strong should be free to prey on the weak, or that human nature is so inherently benevolent nor can be made so benevolent by social influence that people may be counted on to behave well whatever the circumstance.
There are a myriad of legal systems in the cluster to draw upon and each of these may be relevant depending upon the parties involved. I can contribute that, beyond parochialism, behaviour may be effectively regulated by means of norms and social pressure in the absence of legislatures and executives, variants of which are not identical with legislation. It's likely that CCCNP may develop a jurisprudence of norms on a case by case basis. Individuals are often willingly give to strangers, reward good deeds, and punish individuals who violate social norms, even at substantial personal cost in the absence of state influence. The decisions of CCCNP may naturally tend toward a set of equitable remedies, rather than those offered by the common law, taking account of the knowledge and states of mind to operate on the conscience of the parties involved. In the light of Chip's statement CCCNP, having no power to coerce, relies upon an interpretation or an understanding of the issues, whether commercial, legal, or diplomatic facilitating the participants toward reaching a concrete agreement. It also relies upon the assumption that the preservation of prospective benefits in the instant case is desirable, or upon the imperative of establishing good report, the foundation for a prosperous future.

I'm happy to answer your petition in space under the auspices of the Civil Court of New Providence. Since you will appreciate that my freedom of expression is important to me in the role of Star Fraction excutor and public relations guerilla I will place an isk value on your petition of 25 billion isk. If you are prepared to place this sum on deposit care of Chipmo then we'll come and debate the issue (with your greviences) before the Civil court at an appointed time and place. Should the court decide in my favour I will be seeking a portion of the 25b as damages and expenses for my time.

I'm sorry, such a proposition is entirely ludicrous. Not only are Star Fraction completely devoid of the trustworthiness neccessary to guarantee that such a large deposit would not be misappropriated (although, to clarify, you needn't feel especially slighted - there isn't actually a single person or entity in the universe who I consider trustworthy enough to handle a sum of 25 billion ISK, up to and including my own corpmates), there is both no way in which you can reasonably claim anything close to this sum in damages, nor, now that I think about it, is there any possible way you can guarantee me that there is no conflict of interest in the case being decided by a member of your corporation who would be holding I, the plaintiff's money, in "trust".
I am, however, impressed that you managed to address the complaint with acceptable brevity. -----

I guess that if parties are going to set such high barriers to even have a case heard, then the Court will be rather pointless.
Ms. Constantine, perhaps you are trying to be humorous, since obviously mr. Lehane's demand is ludicrous to begin with. I don't believe the court is intended to meet demands but to arbitrate in conflicts. It is not clear to me how ms. Constantine's expression are conflicting with any interest of mr. Lehane.
I also think the name 'Civil Court' is poorly chosen since it does not rely on any body of law but on mr. ChipMo's personal tastes. Perhaps "Arbiter's Court of Free Providence" would be more suitable? ____

To the assembled arbitrators of the CCCNP...
I am here to assert a claim on behalf of those slaves held in bondage by one Revan Neferis. I shall argue that her enslavement of other human beings is a defacto and self-evident crime against humanity. Moreover, I will argue that her presence and operation within the Star Fraction-monitored Free Space is a violation of the basic tenets and aims of free space, and as such she should be liable under that cause of action.
I will ask that those slaves in her retinue and ships be freed immediately, and reparations paid for from property confiscated from the offender. Moreover, I will ask for an injunction holding that her presence be barred from the new-founded Providence Free Space, as her continued presence and operation therein are an affort to the sacrifices freedom-loving organizations such as U'K and Star Fraction have made over the years.
As an organization dedicated to freedom, and against tyranny in all its forms, I've no doubt that Star Fraction would be eager to see these claims asserted. Moreover, as a tribunal obviously dedicated to justice and the furtherance of civilized discourse, I'm certain the CCCNP would be willing to rule impartially, and eventually favorably, on behalf of those unable to speak for themselves.
I humbly and eagerly await this tribunal's response.

I believe Mr LeHane has expressed difficulty laying his hands on the sum of ISK I require as surety and potential damages should the case go against him. As such there is no case to answer. I think its important that people bringing petitions and cases should realize they will often be excepted to risk something themselves, after all, if they aren't prepared to put their isk/reputation/possessions and sureties on the line - why should the defendent?

If "it is" is contracted to "it's", it has an apostrophe. Please remember this in future. It's fairly simple.
As for the money, I am perfectly willing to accept the idea that both sides of a case accept some risk, but you were unable to provide a compelling reason as to why I should take such a large risk by providing a member of your corporation - who you cannot reasonably convince me does not have a vested interest in the case being decided in your favour - with such a large sum of money. Besides, as Merdaneth points out, this court is absolutely worthless if anyone can demand unreasonable surety which, in this case, is very clearly levied simply to cause lock someone out of the court.
But I am nothing if not reasonable - if you require 25b ISK for surety, I am willing to provide it, but I require the Black Plan as my own surety. -----

That would mean you'd need to provide another 75b isk. for 100b total. I'm not sure why this is difficult for you to understand. I place a potential value on my restriction of posting freedom on galnet at the sum of 25b isk. If you want to fight a legal case towards that end that is how much you must personally stake. If you aren't prepared to stake that much there is no case to answer.
