The EULA and TOS prohibit taking your won ISK and turning it into IRL money. Provided you abide by the EULA and TOS, it does not fall under the definition of gambling you are talking about, because you cannot acquire tangible winnings.
Of course, should you chose to take your won isk, and sell it on ebay, then CCP will ban your account, which means you can no longer gamble.
In synopsis, from the point of view of a court of law, when you buy plex, it gains you a non-existent item. They don't care if its a currency that only has value in a specific game, or a sword that only drops on in every thousand boss kills, whatever. Doesn't matter. Nor do they care if, in the context of the game, you can gamble it. What they care about is if you can risk your IRL money to try and earn more IRL money, which you can't within the terms of service.
Thus, from the point of view of the courts, buying a PLEX and using it to gamble in-game currency for more in-game currency is no different to buying a pack of pokemon cards. Either way, money goes in, but does not come out. Its a purchase, nothing more.

EoH im pretty sure also has a Eula saying that you are within your legal right to use such progrma (im pretty sure its a mavens thing) and with that being said even IF it were someone considered illegal to gamble with isk (which it isnt because you are playing with fake internet spaceship monies which have no real value) you wouldnt be able to do anythign anyway as you click i agree to terms and conditions saying you were of age among other things.
In cases like this the worst that would happen is that EoH would be shut down (saying everything goes sideways and no one cares for the law anymore) and people would be reimbursed at the value of thier items (which is 0 because no one playing lost anything of thier own)

It's like someone took the PLEX have RL value argument and wrapped a new layer of stupidity around it. The sad thing is, there are Americans this idiotic. They give the 5% (maybe a little generous) of the population who actually have an IQ higher than room temperature a bad rep. --------------------------------- Pillage, then burn. You have answered your own question here. PLEXs have no real life monetary value within the game. Once you have purchased it on the website, it becomes an in game digital item that remains the property of CCP no matter what. The only reason Second Life ran in to a law suit because of this is because monetary transactions work two ways in that "game". In EVE, they do not.

I'm gonna go with that all in-game assets belong to CCP, so any 'gambling' is pretend. No real $ or actual currency are involved, it's not real gambling. If there was a chance of getting $ out of it, then yes, it's gambling and should require age verification to take part.

What often happens in the UK is that such 'prizes', or tickets for the prizes, will have on them some small print to the effect of "The redeemable value of this coupon is 0.00001p".
There may be something similar here.
Secondly, CCP is not in the US of A.
Thirdly, one of the reasons why I don't live in the USA is that it would be illegal for me to make a living from horse racing within the Land of the Free and would prefer to do it within the United Kingdom where the whole economy here is based on having a punt and has been for nigh on the past one thousand years.
