Well we all play the same game here... What works for one will work for another. Pirates can be caught by the same tactics by which they catch others. Find out where they're hanging out. Guard a gate in the vicinity, and sooner or later you're likely to catch a few flies in your web. I agree that the game mechanics need some adjustment, but until that happens all you can do is use what's available to you, same as the pirates.
I lost a punisher to Lord Zap the other night, because I was on auto pilot, and talking in corp chat instead of being alert, as I should have been. I had a few modules in my cargo I wasn't anxious to lose either, but I'm not going to sit here and blame Zap, call him nasty names, and make idle threats for doing what he does best.(OMFG Mareek, that guy needs help!) I kicked myself in the ass for falling asleep at the wheel. People just love to blame everyone else for their failings.
I like that there is a steep death penalty in this game. Will make it all the sweeter when I finally turn the tables on old Zap, and blast that battleship to smithereens. It wouldn't be very much fun to me if he had a 100 battleships sitting in the hangar waiting to replace the one he lost. It might be fun for a little while if ships were free, but trust me, it would get old quick. The risk could be reduced somewhat from where it is now, but they have to be careful they don't go too far...
One more thing... My character may hate Zap. His goal may be to annihilate his entire corporation into bankruptcy, but I don't hate the guy behind the keyboard, or think he's an awful human being. I don't even know him. He's just a guy playing a game, like I am. As long as he's playing by the same rules then there's no problem. There's a big difference there that some people don't seem to understand. Besides it's good to have a goal that's a little more challenging than breaking my record for mining the most bistot in single evening.
There has to be player vs. player conflict in this game, that's what makes it fun. That's why I bought this game, and not SWG. If somebody ****es me off I don't want my only option to be complaining to a GM. That's lame, I had plenty of that crap in EQ. I want to kick their ass myself. Much more satisfying, and much more fun! Sure it's not fun to be on the losing end of an engagement, but hopefully you learn something, and you come back stronger the next time around.
The argument that you're a paying customer, and CCP should take action to make you happy etc. is not valid. I'm a paying customer too, none of my friends are leaving, and my version of how the game should be seems to fit the description on the back of the box a lot better than yours... In fact it's pretty much how the game is now. Add some of the long awaited content, smooth over a few of the rough edges/balance issues, and Eve will be a real winner in my book.
