Are instas required in empire too? How sad is that, that you have to do the boring work of making instas just to transport your gear in .9, that's just too much work.

Well suicide ganking in empire is not illegal, but CCP have stated that if you are using a recycleble alt or a trial account that you recycle or quit using after a while because of the sec hit... now that IS illegal.
So unless you can prove that they are recycling their alts somehow you can't do nothing but to accept it.

Yeah, I often don't bother with the instas when I'm doing that. I run Eve on a laptop and I leave the cursor over the MWD activation button then just press the left mouse pad button when I come out of warp. You can do that with a mouse as well but usually pressing the button moves the cursor. -- (Battle hardened miner)

It's an exploit if, as other have said, they are recyling their alts.
Opinion though: safe space should be safe. That is, criminal flagging the person who comes to pick up the loot. Yes, cans should have "theft" timers on them, giving you a chance to come and pick up your stuff or go and fit to fight those that got you. At the moment, it's all gone before you've even had the opportunity to get your **** together.
So, contact a GM to see if he can check out whether they were using recycled alts. In the meantime, consider the Risk v Reward equation: you risked everything you owned in a 0.9 (which should be no risk at all), you got rewarded with your ass on a plate and 100% loss. They risked almost nothing, they were rewarded with all your stuff. "RvR ftw!" (as you fan-boys are always so proud of shouting on the forums).

What happened to you is not considered an exploit. It is well within the rules of the game. As long as the attackers lose their ships in the process it is allowed. If you feel anything in game is and exploit please use the "ask a question" feature to your left.

Sadly it has been done for ages, for this reason I always take the time to set instajumps for the entire trip ahead including to the station.
This minimizes the time people have to scan and shoot you down.
I know some people would consider this an exploit but as far as I know its not. Besides the suicide kessie (even if they at this time did a suicide carcal) has been equally called an exploit.
