Well, if CCP decides to get into the MP3 player or online music market, then start applying the term "pod" to some sort of product or service then sure, I suppose we should be worried.

Problem is, Apple has been targeting anything with "pod" in it, whether it applies to music/mp3s or not.

and 1) US copyright law requires the similar/same names to also be related in their nature. Pods in eve would not qualify.
2) CCP isn't a US company.

The company I think you're referring to (correct me if I'm wrong) creates software which downloads podcasts.

Exactly look at paris hilton and her army of lawyers being able to copyright that idiotic phrase "thats hot" because apparently she came up with it. Basically if you have the dosh you can do it.
PS: no one tell her i used it she may sue me -----------------------

That would be funny as hell, since eve was around and using "pod" before apple even thought about ipods.
CCP couldn't possibly lose that case.
And apple is a bunch of tards for attacking popular usage of the word "pod". They created a pervasive culture and now they are trying to quash it? That conclusion is based on an unwarranted assumption; namely, that court judgments always make sense
Given Apple's billions, it is entirely possible that they COULD win a case against CCP. ________________________________________________

I stand ready to be corrected, but I believe that an agricultural company in the states has exclusive rights to the word "Basmati" when applied to rice products on sale, in the states only. Therefore if you're a small farmer in India whose family have been growing Basmati rice for generations, if you want to sell your product in the USA you have to pay royalties.
So no, it wouldn't surprise me if Apple tried to take ownership of the word "Pod" in EVE.

Thats odd. The DMCA is US law. Has nothing to do with copyright. And isn't internationally recognized.

Isn't the technical name for a pod 'capsule' anyways? After all, pilots are sometimes referred to as 'capsuleers' and the story is 'the capsule and the clone', not 'the pod and the pilot'.

That is, unfortunately true.

Ah, but CCP is not selling Pods in any form, nor a product labeled with the Pod name. So Apple really has no case against them. Not to mention that CCP (I hope) has TM rights on EVE, Pod-pilot, and other such key words and phrases. Which would preclude apple from sueing them.
Your example is correct, but doesn't correlate with whats going on with apple. Not in reguards to eve anyway.

As I understand it, they have to defend their trademarks aggressively or risk losing them in the US. They also seem to have problems registering similar words as trademarks ("ipodcasting"?) while such usages of "pod" are so widespread.

I hope this makes the term die completely.
Then Disney can kill the MMO usage of 'toon'.
Podcast is a horribly stupid term, and it leads ALOT of tend*****-types to honestly believe the iPod is some sort of revolutionary thing, and that it gave birth to portable media.

Apple is retarded, god. if they are going after ANYTHING with Pod in the name, then they will loose. As mentioned. Theres shoes named Pod, theres the large national storage company POD (or is it PODS? doesnt matter). And im sure there are alot more. This isnt a move by apple to squash the use of POD i bet, its a move to get royalties...greedy bastages. But this whole thing is rather idiotic. They start something big with their IPods, then get mad that it took off so well. Dude...thats like transfering over from corn husks to toilet paper and the inventer of toilet paper getting bent out of shape. Its trully..a stupid issue. And personally, i hate ipods. They are too dang big. Ill take my roxio, about 1/4 the size, and holds about 1/4 as much but hey! i dont plan to listen to 20gigs of music at a go. Anyways. Apple is seriously retarded for this whole thing they are trying to pull and I can only hope that they crash n burn like they were supposed to so many years ago and take their p.o.s. items off the market (Yes, personal opinion, dont even bother flaming it).

Apple is specifically objecting to the other company's attempt to trademark 'Podcast Ready'. Not the name 'podcast' in general. It'd be like a car part manufacturer trying to trademark 'Toytoa Compatible' for their parts. Toytoa obviously would have good grounds for complaining saying that they trademarked Toyota, other people don't get to use it without some sort of prior agreement.
In any case, a PodiPod would be great, my crewmembers choose the worst radio stations. |

I didn't say that what Adobe did was right, or that they got a conviction, that's not the point.
Adobe still won, and Skylarov lost. He got arrested, and into endless expensive and lengthy legals procedures that tied up years of his life. Even if Adobe dropped charges against him, he's never going to code this kind of stuff again. Adobe 1, Skylarov 0.
The point is, Apple is using intimidation tactics, pure and simple. Small companies and individuals have the choice of fighting an expensive battle in court (potentially), settle, or bend over. If they don't, and they are not a US company, then they will have trouble doing business in the US.
US laws like the DMCA make that kind of legal abuse possible everywhere in the world.
- Got grief?

The manners in which CCP and Apple use the word 'pod' are significantly different, enough so that the chances of action being brought about by Apple against CCP are negligible. We have the advantage of prior use and pod is a common useage word.
It does make for an interesting story, however.
