you keep saying "go do something" but never acknowledging that YOU CANNOT DO ANYTHING.
if you shoot them before they can grab the can and instawarp out, you get concorded (and then they laugh at you and take the can anyway). if you wait until after they're flagged, you can't get them in time. bounties are worthless. you can't wardec the newb corp. there are no other options.

your idea of getting even is losing a ton of standing for mission failure, plus hours of your time camping a station and hoping he undocks in something you can gank before concord kills you, plus the secloss for the gank if he actually undocks? you lose a lot and gain nothing in return (because he's most likely trashed the item), and he had essentially zero risk for the whole operation because you can't touch him and the npcs aren't much of a threat.
if he wants to go into missions and blow up all the ships, or loot your cans and blow you up when you use the can-flag to shoot him, that's fine. but when he's abusing game mechanics to make you incur huge penalties while never being in any danger himself, that's broken.
mission-critical loot items should only be lootable by the mission owner.
