I think he is saying that crime is a figment of our collective consciousness. If the collective thinks it is "wrong" or "criminal", then it is (or at least our perception of it is). For instance, I have a friend IRL who stood up for a family member and did what he thought was right (and TBH, 150 years ago, he'd have been a hero for doing what he did), he spent a good deal of time in prison because of standing up for someone who was directly in harms way.
