EVE Search - Rules of Engagement

A PK shows up and opens fire at the indy. Can a gunner from the gang (same grid) now answer the fire without getting concorde (remember, the gunner was NOT shooted at, the PK shooted at the indy which is in the gang of the gunner). No1 could answer this for sure so far.
