Quote: A 49-year-old Missouri mother has been indicted for fraudulently using MySpace to "cyber-bully" a teenage girl who committed suicide after she was tricked into believing she was being dumped by her online boyfriend.
Lori Drew, of O'Fallon, Missouri, was named in a federal indictment charging her with three counts of accessing protected computers without authorization and one count of conspiracy. She faces a maximum of 20 years in federal prison. She has been summoned to appear in US District Court in Los Angeles in June.
The MySpace charade has drawn international ire since it was first reported that Drew posed as a 16-year-old boy on the social networking site and drew 13-year-old Megan Meier into a romantic relationship. After feigning interest in the girl for several weeks, Drew and several unnamed co-conspirators, abruptly broke off the relationship, telling her: "YouÆre a ****ty person, and the world would be a better place without you in it."
Within hours, Meier hanged herself in her bedroom closet using a cloth belt her mother had just purchased from Old Navy, according to this article in The New Yorker.
According to news reports and television interviews, Drew set up the MySpace account after her daughter had a falling out with Meier. Drew allegedly used the account to find out if Meier was badmouthing her former friend online.
Drew has steadfastly denied any wrongdoing, although in the past she has admitted to playing a role in the MySpace hoax. On Thursday, after the indictment was handed down, Drew's attorney told The Los Angeles Times he planned to vigorously fight the charges.
According to the indictment, Drew and the co-conspirators used MySpace to "torment, harass, humiliate, and embarrass the juvenile MySpace member." Posing as Josh early on in the online courtship, the faux boyfriend told Meier she was "sexi" and invited her to touch the "snake." Just hours after Meier killed herself, Drew and the co-conspirators deleted the fraudulent account and Drew instructed a juvenile who was aware of the scheme to "keep her mouth shut."
The indictment is notable because it comes after local police in Missouri declined to file charges because, they said, there were no statutes under which to pursue a criminal case. Federal prosecutors in Los Angeles, in the district where MySpace is located, then began their own investigation.
Their charges hinge on the allegations that Drew violated MySpace terms of service that, among other things, require users to provide truthful and accurate registration information and forbid them from using information obtained from MySpace to harass, abuse or harm others, from soliciting personal information from people under 18 and from posting photos of others without their consent

I read about this on the news, its disgusting that a person of that age resorted to such immature acts. I feel so sorry for the parents of the girl and its a tragic loss at such a young age. Maybe the woman be sentanced to life.

Experts Say MySpace Suicide Indictment Sets 'Scary' Legal Precedent
"A nationwide community backlash ensued, after a news story published last year revealed Drew's role in the cyberbullying, and pressure was placed on Missouri authorities to charge Drew with a crime. But after investigating the incident, local prosecutors concluded last December that they could find no law under which to charge Drew.
That's when federal prosecutors began working to build a case -- a difficult task, given that there is no federal law against cyberbullying. On Thursday, the U.S. Attorney's Office in Los Angeles unveiled its solution by charging Drew with "unauthorized access" to MySpace's computers, for allegedly violating the site's terms of service.
MySpace's user agreement requires registrants, among other things, to provide factual information about themselves and to refrain from soliciting personal information from minors or using information obtained from MySpace services to harass or harm other people. By allegedly violating that click-to-agree contract, Drew committed the same crime as any hacker.
That sets a potentially troubling precedent, given that terms-of-service agreements sometimes contain onerous provisions, and are rarely read by users."

What she did is reprehensible but not necessarely punishable. It could have been an actual guy doing the very same. Would you then blame the guy for the young girl killing herself for being dumped and verbally hurt? Come on. Reprehensible and unfortunate, but that's all. If you tell someone to "go and DIAF" and he actually sets himself on fire you still haven't committed a crime. --------------------------------------------- GET TO THE CHOPPA!!! Read the article linked above and the quote from it. They're NOT indicting her for that, because it's not illegal. They are trying to convict her of breaking MySpace's EULA, which states you should give your REAL details. And that's why it's a nasty legal precedent.

I don't have to since I've already listened to several discussions about it cast on radio. I still say: she shouldn't be brought before court for harassing someone.

These charges are bull****. "Torment, harassment, humiliation, and embarrassment" happen every day in schools of all grades across the globe and no one is ever criminally charged for it. I hope this woman gets off. Obviously the girl that killed herself wouldn't have survived in this world. It gets MUCH worse than stupid **** on MySpace.

You are judging the girl that killed herself from a wrong perspective. She was not an adult but a thirteen year old girl. Not exactly a kid anymore, but still far away from being adult and still not fully developed in her psyche. There are reasons why a teenager that does something wrong is judged differently than an adult of 30 years.
Bullying the girl was wrong and that a mother participiated in this makes it even worse. That woman is the real ***** in this case.

As someone who was on the reciving end of bullying and even a threat on my life (yay post Columbine era...)during my teenage years I would say that girl was already messed up in the head to be that distraught over digital bullying to the point that she would take her own life.
As for the 50 year old, shes equally messed up in the head, but I dont know if these charges will actually stick. The internet is a funky place when it comes to law. The closest thing someone can use as an identity is an IP address and even then there is no proof that its the owner of that address at the keyboard.
This is ultimately a case of the messed up messing with the messed up and I doubt anything will really come of it or if it does, it will be technicallity stuff such as giving false information, and I doubt that any reasonable measure of jail time could be applyed to that and expect not the be overturned by a higher court. -------------------------------- To borrow a phrase:

Woman indicted in Missouri MySpace suicide case
"Megan's death was investigated by Missouri authorities, but no state charges were filed because no laws appeared to apply to the case."
"U.S. Attorney Thomas P. O'Brien said this was the first time the federal statute on accessing protected computers has been used in a social-networking case. It has been used in the past to address hacking. [...]Both the girl and MySpace are named as victims in the case, he said."
"Drew was charged with one count of conspiracy and three counts of accessing protected computers without authorization to get information used to inflict emotional distress on the girl. [...]Each of the four counts carries a maximum possible penalty of five years in prison. Drew will be arraigned in St. Louis and then moved to Los Angeles for trial."

Translation, they couldn't indict her for being a pain in the ass or somesuch, so they decided that "breaking MySpace's EULA" could be pushed as "hacking" and have her in court, where enough public outrage might actually sway some gullible jury to find her guilty. She will obviously have appeals after appeals until the case is eventually dropped, but not before she spends a lot of time in jail during all the court proceedings (because I suppose the bail WILL be set quite high)... but she MIGHT be stupid enough to plea-bargain (or worse) just to spend less time in jail, and then a very dangerous legal precedent will be set.

Except you're forgetting that everyone here has been a teenager or is one now and we haven't killed ourselves. I've been victim to plenty of bullying while in school, but I took it like everyone else does at that age. The thought of killing myself never once came across my mind. They are not judged differently, as any child that would ever consider suicide as an option got the idea from someone else. Probably their parents. Children do not know the concept of killing ones self to end their suffering until they get much older.
A child would also have to be unstable mentally to consider such an option as well. Normal children go to their parents and have them try to solve their problems for them. Their parents are their protectors. Everything can be solved by asking their parents for help. That is the mentality of a child in distress. Suicide is never considered. --- My cat Putter approves of this post. Be a Ninja! You know you want too: http://www.animecubed.com/billy/?Kravick |

Heck, it appears that the actual suicide was caused by the message sent by SOMEBODY ELSE, not the one who's awaiting trial...
" Last month, an employee of Drew, 19-year-old Ashley Grills, told ABC's "Good Morning America" she created the false MySpace profile but Drew wrote some of the messages to Megan. [...] Grills also said she wrote the message to Megan about the world being a better place without her. The message was supposed to end the online relationship with "Josh" because Grills felt the joke had gone too far. "I was trying to get her angry so she would leave him alone and I could get rid of the whole MySpace," Grills told the morning show. "
Would this have been another teenager dumping her telling her exactly the same things, she would have probably commited suicide anyway. SHE WAS unstable. This wasn't murder. It was an unfortunate accident.
And for at least the third time in this thread, I have to repeat : they are NOT charging her with MURDER. They are charging her with something akin to "hacking MySpace" and "conspiring to inflict emotional damage". Sheesh, you'd think people would actually read...

I know, thats why I said its bull****. LOLemotional damage doesn't hold up in court. And "hacking" myspace? I didn't see that in the article. There was an account created under a false description but thats hardly hacking.
As far as the EULA being a binding contract. I don't know about other countries but unless you physically sign your name to a EULA its not considered a legally binding contract in the states. Those always get thrown out as evidence. Clicking "I Accept" doesn't constitute legality as "anyone" can click that and let someone else use said account. --- My cat Putter approves of this post. Not true - when was the last time you harassed and teased someone into suicide? Really?
Sure, we all do that - it's our nature, but there is a point when teasing becomes harassment. There is a huge differance - it dosn't take a rocket scientist to see this.
People also eventually grow up, kids are always very cruel to each other, but eventually when people grow up they develop the brain capacity to know better. Some just don't ever grow up though, and some are just ****** up in general - like this woman.
This is why we have prisons and asylums - to keep these people away from the rest of society so they don't cause harm to everyone else who is fine and not hurting anyone.
You cannot compare this kinda thing to some children teasing another kid for their name or clothes. Do you still want to continue trying got justify that? Try it - you can't justify it, ever.
It's one thing to tease just to be a ass, or just for the sake of playing with someone - but most people, most adults, don't cross that line. This woman intentionally went into playing mind games in effort to harm someone; most good, normal people doing ago around trying to hurt others intentionally. ____________________
