Quote: A 49-year-old Missouri mother has been indicted for fraudulently using MySpace to "cyber-bully" a teenage girl who committed suicide after she was tricked into believing she was being dumped by her online boyfriend.
Lori Drew, of O'Fallon, Missouri, was named in a federal indictment charging her with three counts of accessing protected computers without authorization and one count of conspiracy. She faces a maximum of 20 years in federal prison. She has been summoned to appear in US District Court in Los Angeles in June.
The MySpace charade has drawn international ire since it was first reported that Drew posed as a 16-year-old boy on the social networking site and drew 13-year-old Megan Meier into a romantic relationship. After feigning interest in the girl for several weeks, Drew and several unnamed co-conspirators, abruptly broke off the relationship, telling her: "YouÆre a ****ty person, and the world would be a better place without you in it."
Within hours, Meier hanged herself in her bedroom closet using a cloth belt her mother had just purchased from Old Navy, according to this article in The New Yorker.
According to news reports and television interviews, Drew set up the MySpace account after her daughter had a falling out with Meier. Drew allegedly used the account to find out if Meier was badmouthing her former friend online.
Drew has steadfastly denied any wrongdoing, although in the past she has admitted to playing a role in the MySpace hoax. On Thursday, after the indictment was handed down, Drew's attorney told The Los Angeles Times he planned to vigorously fight the charges.
According to the indictment, Drew and the co-conspirators used MySpace to "torment, harass, humiliate, and embarrass the juvenile MySpace member." Posing as Josh early on in the online courtship, the faux boyfriend told Meier she was "sexi" and invited her to touch the "snake." Just hours after Meier killed herself, Drew and the co-conspirators deleted the fraudulent account and Drew instructed a juvenile who was aware of the scheme to "keep her mouth shut."
The indictment is notable because it comes after local police in Missouri declined to file charges because, they said, there were no statutes under which to pursue a criminal case. Federal prosecutors in Los Angeles, in the district where MySpace is located, then began their own investigation.
Their charges hinge on the allegations that Drew violated MySpace terms of service that, among other things, require users to provide truthful and accurate registration information and forbid them from using information obtained from MySpace to harass, abuse or harm others, from soliciting personal information from people under 18 and from posting photos of others without their consent

I read about this on the news, its disgusting that a person of that age resorted to such immature acts. I feel so sorry for the parents of the girl and its a tragic loss at such a young age. Maybe the woman be sentanced to life.

Experts Say MySpace Suicide Indictment Sets 'Scary' Legal Precedent
"A nationwide community backlash ensued, after a news story published last year revealed Drew's role in the cyberbullying, and pressure was placed on Missouri authorities to charge Drew with a crime. But after investigating the incident, local prosecutors concluded last December that they could find no law under which to charge Drew.
That's when federal prosecutors began working to build a case -- a difficult task, given that there is no federal law against cyberbullying. On Thursday, the U.S. Attorney's Office in Los Angeles unveiled its solution by charging Drew with "unauthorized access" to MySpace's computers, for allegedly violating the site's terms of service.
MySpace's user agreement requires registrants, among other things, to provide factual information about themselves and to refrain from soliciting personal information from minors or using information obtained from MySpace services to harass or harm other people. By allegedly violating that click-to-agree contract, Drew committed the same crime as any hacker.
That sets a potentially troubling precedent, given that terms-of-service agreements sometimes contain onerous provisions, and are rarely read by users."

What she did is reprehensible but not necessarely punishable. It could have been an actual guy doing the very same. Would you then blame the guy for the young girl killing herself for being dumped and verbally hurt? Come on. Reprehensible and unfortunate, but that's all. If you tell someone to "go and DIAF" and he actually sets himself on fire you still haven't committed a crime. --------------------------------------------- GET TO THE CHOPPA!!! Read the article linked above and the quote from it. They're NOT indicting her for that, because it's not illegal. They are trying to convict her of breaking MySpace's EULA, which states you should give your REAL details. And that's why it's a nasty legal precedent.

I don't have to since I've already listened to several discussions about it cast on radio. I still say: she shouldn't be brought before court for harassing someone.

These charges are bull****. "Torment, harassment, humiliation, and embarrassment" happen every day in schools of all grades across the globe and no one is ever criminally charged for it. I hope this woman gets off. Obviously the girl that killed herself wouldn't have survived in this world. It gets MUCH worse than stupid **** on MySpace.

You are judging the girl that killed herself from a wrong perspective. She was not an adult but a thirteen year old girl. Not exactly a kid anymore, but still far away from being adult and still not fully developed in her psyche. There are reasons why a teenager that does something wrong is judged differently than an adult of 30 years.
Bullying the girl was wrong and that a mother participiated in this makes it even worse. That woman is the real ***** in this case.

As someone who was on the reciving end of bullying and even a threat on my life (yay post Columbine era...)during my teenage years I would say that girl was already messed up in the head to be that distraught over digital bullying to the point that she would take her own life.
As for the 50 year old, shes equally messed up in the head, but I dont know if these charges will actually stick. The internet is a funky place when it comes to law. The closest thing someone can use as an identity is an IP address and even then there is no proof that its the owner of that address at the keyboard.
This is ultimately a case of the messed up messing with the messed up and I doubt anything will really come of it or if it does, it will be technicallity stuff such as giving false information, and I doubt that any reasonable measure of jail time could be applyed to that and expect not the be overturned by a higher court. -------------------------------- To borrow a phrase:

Woman indicted in Missouri MySpace suicide case
"Megan's death was investigated by Missouri authorities, but no state charges were filed because no laws appeared to apply to the case."
"U.S. Attorney Thomas P. O'Brien said this was the first time the federal statute on accessing protected computers has been used in a social-networking case. It has been used in the past to address hacking. [...]Both the girl and MySpace are named as victims in the case, he said."
"Drew was charged with one count of conspiracy and three counts of accessing protected computers without authorization to get information used to inflict emotional distress on the girl. [...]Each of the four counts carries a maximum possible penalty of five years in prison. Drew will be arraigned in St. Louis and then moved to Los Angeles for trial."

Translation, they couldn't indict her for being a pain in the ass or somesuch, so they decided that "breaking MySpace's EULA" could be pushed as "hacking" and have her in court, where enough public outrage might actually sway some gullible jury to find her guilty. She will obviously have appeals after appeals until the case is eventually dropped, but not before she spends a lot of time in jail during all the court proceedings (because I suppose the bail WILL be set quite high)... but she MIGHT be stupid enough to plea-bargain (or worse) just to spend less time in jail, and then a very dangerous legal precedent will be set.

Except you're forgetting that everyone here has been a teenager or is one now and we haven't killed ourselves. I've been victim to plenty of bullying while in school, but I took it like everyone else does at that age. The thought of killing myself never once came across my mind. They are not judged differently, as any child that would ever consider suicide as an option got the idea from someone else. Probably their parents. Children do not know the concept of killing ones self to end their suffering until they get much older.
A child would also have to be unstable mentally to consider such an option as well. Normal children go to their parents and have them try to solve their problems for them. Their parents are their protectors. Everything can be solved by asking their parents for help. That is the mentality of a child in distress. Suicide is never considered. --- My cat Putter approves of this post. Be a Ninja! You know you want too: http://www.animecubed.com/billy/?Kravick |

Heck, it appears that the actual suicide was caused by the message sent by SOMEBODY ELSE, not the one who's awaiting trial...
" Last month, an employee of Drew, 19-year-old Ashley Grills, told ABC's "Good Morning America" she created the false MySpace profile but Drew wrote some of the messages to Megan. [...] Grills also said she wrote the message to Megan about the world being a better place without her. The message was supposed to end the online relationship with "Josh" because Grills felt the joke had gone too far. "I was trying to get her angry so she would leave him alone and I could get rid of the whole MySpace," Grills told the morning show. "
Would this have been another teenager dumping her telling her exactly the same things, she would have probably commited suicide anyway. SHE WAS unstable. This wasn't murder. It was an unfortunate accident.
And for at least the third time in this thread, I have to repeat : they are NOT charging her with MURDER. They are charging her with something akin to "hacking MySpace" and "conspiring to inflict emotional damage". Sheesh, you'd think people would actually read...

I know, thats why I said its bull****. LOLemotional damage doesn't hold up in court. And "hacking" myspace? I didn't see that in the article. There was an account created under a false description but thats hardly hacking.
As far as the EULA being a binding contract. I don't know about other countries but unless you physically sign your name to a EULA its not considered a legally binding contract in the states. Those always get thrown out as evidence. Clicking "I Accept" doesn't constitute legality as "anyone" can click that and let someone else use said account. --- My cat Putter approves of this post. Not true - when was the last time you harassed and teased someone into suicide? Really?
Sure, we all do that - it's our nature, but there is a point when teasing becomes harassment. There is a huge differance - it dosn't take a rocket scientist to see this.
People also eventually grow up, kids are always very cruel to each other, but eventually when people grow up they develop the brain capacity to know better. Some just don't ever grow up though, and some are just ****** up in general - like this woman.
This is why we have prisons and asylums - to keep these people away from the rest of society so they don't cause harm to everyone else who is fine and not hurting anyone.
You cannot compare this kinda thing to some children teasing another kid for their name or clothes. Do you still want to continue trying got justify that? Try it - you can't justify it, ever.
It's one thing to tease just to be a ass, or just for the sake of playing with someone - but most people, most adults, don't cross that line. This woman intentionally went into playing mind games in effort to harm someone; most good, normal people doing ago around trying to hurt others intentionally. ____________________

I say again.. a recruit tried to cut his wrists because a drill instructor was mean to him... I guess we sould arrest the drill instructor for attempted murder then
Hey, now I got a way to get back at anyone who ****es me off!

I think your the one who's naive. Do you live in a street snorting ***** with prostitutes or something?
There's such a thing as morals, and there's such a thing as decent people - your out of your mind if you think the entire world is complete sodomy.
To say that there is no decency in the world is just as flawed as saying there is nothing wrong with the world.
I'm living proof that your wrong, and theres a lot of other people out there; some people do actually stop and think to themselves, "this is wrong, I shouldn't do this". I feel sorry if being nasty, cruel, sick, and criminal is all you know, and that you live under a rock thinking everyone else is just like that.
Your also playing EVE too much if you think real life is like EVE and everyone in real life are cutthroats like you can be in EVE - EVE is really designed to be harsher then life really. It's designed to be a recreational tool to get away from real life. Prey your ass out of your computer chair and go get a life or something. ____________________

Its pointless to argue with you, but I will leave you some facts to consider.
The middle east, by our standards, is considered one of the most ruthless and militant areas in the world. Several countries there are ruled by people we considered deranged sickos. Yet the world still prospers.
Japan has the worlds highest suicide rate because of its ultra capitalistic government. Corporations will literally, and legally, take every single thing you own and leave you on the street without a penny to your name and jobless. Most other countries in the world have laws to prevent this sort of thing. The pressure on their children to succeed academically is so insane that children often kill themselves due to the pressure placed on them. You don't get to go the collage there unless you're in a top percentage of your class. Yet no one cares these kids are taking their lives. The world still prospers.
People are killed in accidents, murders, and suicides of all sorts world wide. No one cares these events happen unless the person involved was a friend, family member, or some act of terrorism. People killing themselves are meaningless. One person dying is a tragedy. Casualties in a war are a statistic. No one mourns the loss of those that have died unless you knew them personally. Its the simple truth.
The world does not share your views and opinions Amastat. They are just that, views and opinions. Unfortunately I know better than to try and argue against them. I won't be replying to you any more. Nowhere does it say the woman convinced or willed her to commit suicide (What was expressed is a statement of opinion which is covered by America's first amendment). She probably didn't know this woman who was doing it, and genuinely thought her e-boyfriend dumped her, so she commits suicide. She had to be in a fragile state of mind to do so. So she would have do it even if HE had dumped her.
I have no doubt that the woman and others involved are have serious problems themselves, and are quite despicable, and I'm in no doubt no laws were broke, and the charges of conspiracy and "hacking" hold about as much water a a bottomless bucket.

For every example you mention here, an opposite can be given of things that are right in the world. You're right about human nature, we can all be cruel and ruthless. We can also all be kind and caring. Your first 'fact' is exactly what I mean: despite of all the things we can consider wrong the world still prospers. There is a reason you can identify your facts as 'bad things in this world'.
The majority of the people on this planet are good people with a normal sense of what is basically right and what is basically wrong. Are humans capable of cruel things? Yes. Do all people bully others? I doubt it, but I know everybody is capable of it and the vast majority has done so at least once. I actually want to go as far as saying that bullying / getting bullied is part of social education, just as lying is. Just because it is part of being human doesn't mean it should be ignored and that the average human is not basically good.
Even though I don't agree with you on your suicide-stance, Kravick, I do agree with you that the girl should have dealt with it just like the rest of the world does. The older woman however should have known better and proves that she's not fit for being a mother. As for the charges....those are just ridiculous.

I apologize to those I worked up, for their lives sucking so bad and they have a suicidal, depressing, and bloodstained view of themselves and the rest of the world, and their need to argue over something pointless in hopes others will join them in feeling as worthless as they are. ____________________

Verbal abuse? that would have been a neat trick via a text interface...
While I don't actually defend the woman in question (not without a damm sight more info), I will not heedlessly assume that this is what she was aiming for (again without a damm sight more info). The only person that that can actually say why the girl killed herself is the girl so with out some actual proof that this is why she did so or proof that this was the wanted outcome all the self rightous ****s that are screaming that she did it on purpose and assuming that this was the deisred outcome of the incident.
From some of the articles about this it started because the sucide did/said something to get to the dautgher of the person that you all screaming against, revenge for something the sucide did...so what is it a sick twisted nutter or mother that went to far in trying get payback for her kid...you decided... ========= "I am not saying there should be capital punishment for stupidity, but why can`t we just take the safety labels off everything and let the problem fix its self

I agree with this but you have to consider what you're saying about making it a law. What the lady did was morally reprehensible, no question, but she wasn't in violation of any law. And what law could you make to classify what she did? If you made it illegal for someone to *harass* another person which led to their harm/death, what happens if someone takes their life after a parent calls them naughty, partner breaks up with them, playground bullying or teacher gives them an A-?
The same goes for the myspace thing....if I forget to update my age on there after a birthday, or say I weigh less than I actually do, I'm in violation of the above...go to jail for 20 years? What about guys/girls playing Eve with a female/male avatar? Or serious RPers in (MMO)RPGs? As twisted as the woman is, she hasn't broken any traditional law and there's no easy way to classify what she's done without making almost everyone of us just as guilty of her of viloating MySpace T&Cs or whatever.
Although the police might not be able to get her, I hope Dexter does. -------------

Yeah, I was pretty tired, I think I just read conspiracy. But I doubt that conspiracy to break a EULA or T&Cs exists.

Because people dying is funny right no matter how it happened? lol -1 emo.
That is not a healthy way to think, if you do think like that then maybe you need to go find something that gives you some perspective on life. A 13 year old girl is now dead, that's not funny and I very much doubt she deserved it.

This case is incredibly loaded. For starters because it claims she did wrong for providing false details when everyone who doesn't want their identity stolen does that now and then.
The problem is that there is no crime covering what she did to the child. There needs to be legislation against cyber-bullying but this is like the good old days of prosecuting computer hackers for using electricity without permission. ---- Infiniband can do more than just prevent lag |

Get the DVD and turn on the commentary... Eli Roth confirms he based the movie on what some militant groups in Thailand do. You pay them and they'll let you execute someone they've abducted

Actually, that sums up a decent portion of EvE right there.
Was the act pretty lame? Yup sure was. Was the girl's death a shame? Yup sure was. Was the person "sick" for doing it? Nope not really. The act itself was poor taste. The fact that the 13yr old girl lacked the emotional stability or social/family network to get over the incident like so many millions of other 13yr old girls before actually killing herself over an person she had never met except online does not make the act any worse than it was.
There are a few million geeks, nerds, and dorks who have not only been the victim of mindgames (most of the male species has been victim at some point) and who have participated in the act as well for various reasons. And yet whether they chose to live or to kill themselves (or their victims killed themselves) still has no bearing on the act itself.
Then again society is starting to go down the "relativity of victimization" path.

As someone who has thought of suicide since my age was a single digit, Im going to have to call shenanigans on this as I do not recall my parents ever telling me to kill myself.
This woman set out to grief this kid, is it not at least harassment?

Edited by: Slade Trillgon on 20/05/2008 18:59:40 I will say that the only thing that they could really get her on is breaking the EULA and/or hacking her daughters account.
There is no case to be had on holding the mother responsible for the daughters death, criminally. About the only crimal charge they could possible get the mother on is Cyber Assult (if there is such a thing) if any threats of violence were made.
This is a prime example of why, at least in the US, we have Civil Courts. In the Civil Court they definately have a case for punitive damages for sure.

Edited by: Hooch Flux on 21/05/2008 13:11:45 Megan was a 13 year old girl with a weight problem and depression (was medicated)! Lori Drew knew this as her daughter and Megan had been friends for years, they had a falling out and Lori (allegedly) decided to create this Myspace account (Josh) to find out if Megan was talking smack about her daughter online (what kind of responsible mother does something like this to begin with, it's a children's argument?).
The tone of the exchange started to change over time as Megan started to take the whole BF thing more seriously (Unsurprisingly this is pretty normal for an insecure teenager). Lori decided to break it off because it was getting too serious (Fair Enough), then the messages started getting vindictive with confusion on Megan's side (Why had this boy that she thought she was having a relationship with shunning her all of the sudden (Now I don't know about the rest of you but it is easy to look at this and say "Get over it", and any rational adult would, but do you remember when you were a teenager and how everything that happened was "Super Serious"?)
Lori could never have predicted that outcome so I would have to say that it was totally accidental, but Lori should also have been responsible enough of an adult that she should have just stayed out of it!
Did she commit a "legal" crime, doubtful!
Was she irresponsible, yes!
As for people who suggest that bullying happens to everyone and they don't commit suicide "yadda, yadda, yadda", sure, that's true. But not everyone is tough like that, there are vulnerable people out there!
It's tragic that this happened, and to most of us it looks like a total overreaction, but to an insecure 13 year old girl it was the end of the world!
To me Lori did nothing legally wrong, but she demonstrated very bad parenting skill by getting involved in a childish spat!
Apparently from what I have gathered, the DrawÆs have had to close their business and have pretty much been run out of town!
It's also interesting to note that Lori Drew came out with some very nasty things to say in her defence when she should have probably kept her mouth shut! (Those things are probably what got the Drew's run out of town!)
I say prep for dustoff, nuke the site from orbit...
Only way to be sure! |

I'm not sure what is more scary. The fact that cyber bullying is currently illegal in 10 of 50 states, or the fact that there was a federal case of "you didn't put your real information on myspace".
