It certainly isn't a misuse of the term. Res ipsa loquitur is a legal doctrine where you don't have to establish two elements of negligence in order to prove negligence - you don't have to establish duty or breach. The reason? Because what happened is so egregious that such a thing would NEVER happen in the absence of negligence. Thus the law infers a duty and a breach of duty. In essence, what the doctrine says is that "the fact this event occurred is, in and of itself, proof of negligence."
So . . . what I am saying here is that this completely lame tactic is, without further discussion, proof of UNICORN's cowardice (or at least the lamers that took part in it tonight). The thing speaks for itself. Res ipsa loquitur.

EDIT: an example of real world res ipsa loquitur would be a situation where an automobile is driving down the road when the gas tank spontaneously combusts, killing the occupants. When the next of kin sue for wrongful death, they won't be required to articulate that the car manufacturer had a duty to make a safe gas tank, nor will they be required to show exactly how the gas tank exploded, what went wrong, or where the defect in the thing was. Since gas tanks don't usually explode in the absence of negligence, the res ipsa loquitur doctrine would apply, and the car manufacturer would lose.

This coming from old fe guys, who are the absolute king of the- 25 scorps sitting at 200km running ecm, is kinda funny.
In the end though, I agree with cao cao. Ecm spoils a lot of decent fights, and is over powered, dampers especially.
If they completely took ecm and ew stuff out of the game tomorrow, I wouldn't shed a tear.

We have waited days for a decent battle, and it looked like we were gonna get one until the bull**** tonight. Oh well.
Like I said earlier, it would be one thing if they were outnumbered and used something like this to gain an edge. However they had vastly superior numbers and they still felt they had to be the Kings of Cheap. Either way, it was just dumb, nobody lost ships, and they got to sit longer at safespots. Whoop-dee-doo.
