It also matters since you can't actually play the game without connecting to CCP's servers. Even if the EULA doesn't apply, that won't get you anywhere because CCP does not have any legal obligation to provide the service. The caveat to this is that if CCP decided to shut down EVE without refunding remaining subscription time, the right court may order them to do that, but no more.

Simply put the the $15 dollars a month technically is for having an account and keeping it active beyond the Trial period.
Your characters information is stored in their servers database and you are paying for the little bit of storage your character and all it's items earned in game hold.
So while people can try to get nit picky and legal over what rights you have that is basically what you are getting.
Break their EULA/TOS and they can deny you the ability to access that storage area.
THey could if they wanted to delete and reuse the space your character holds when your $15 a month rent on it is not paid but majority of online games do not do this although they state that they may after a set period of time but i have yet seen one that does and the time period is usually stated in the TOS.
So in the interest of banning and non-payment the only thing that is truly denied access to the server is your account on which the characters reside.
You the real person on the otherhand are still not banned and since your character has no rights at all you can't say your rights have been violated.
I see all the people that throw up laws from all different countries and what not but they fail to realize that those rights apply to the real person and in no way shape or form apply to the account/characters that reside in the game and that is what truly gets blocked.

All EULAs mention that you own no right to the game and do not have the right to crack it/reverse engineer it/etc. It also usually mentions that they can revoke your right at any time and hold no responsibility to keep the online servers online.

You don't have rights to jack.
In a RL case, a university in my city right now has its workers on strike. All classes are canceled, and has been on strike since november and continues now, so that means they have lost their entire academic year. So all 60,000 students have paid several thousand dollars for tuition for the year that they were supposed to get, and they wont be getting it back.
Most organizations and businesses don't have to do anything for you unless it is specifically stated in the contract. |
