Yeah well they didnt. I tried. And there was no shield on any Starbase I checked, could fly right up to ships and steal them.
That is a bit of an exploit I'd say.

Well actually, I was basing that on something I had heard about Concord's modules not working either. You only have to use your imagination to realise how that could be abused. But, you may be right, I don't really know.

1. Its interesting that people stay connected during downtime. 2. I have not been able to connect since downtime's scheduled return, 12:00 GMT. (I dont get confused about things like "time", its really simple **** people.) 3. This is the time that I normally play, what kind of reimbursement can I expect from unscheduled downtimes CCP? None as usual?

Someone should read the EULA. It stats in there that they arn't responsible for unscheduled downtimes and no reinbusment will be done. Sometimes they will but usually tahts only if there going to have it offline for 12+ hours. --------------------------------------------------- Ummm ya.... |

As much as this little unexpected D/time has'nt bothered me, its just one of those things.
Ive waited patiently until the servers have came back and logged in.. my ship and char were safely docked, and I am now happily going about my business..
however, I think that little disclaimer in the EULA is utter bollox.. who's responsibility is it ? Again im not whining, but thats like saying, i will kick you in the teeth, steal your wallet and I am not responsible.
There CCP's servers, and they maintain them.

I think somebody needs a little perspective. Having an unexpected downtime is in no way comparable to being physically assaulted and mugged.

Service level agreement. It's a contract, between a customer (that'd be you) and a supplier (that'd be them).
A service level agreement is generally a statement of 'guaranteed' uptime, with penalty clauses outside the agreement. e.g. up to 1 hour per day between 11-12GMT.
In this way, the service level build resilience in, as the supplier over-engineers in order to meet the customer need.
Need I point out that this costs a LOT of money? I'll happily build you a 99.999% uptime system. But it'll cost you an _awful_ lot of money. (And no, you can't pay in isks). I believe Sun Microsystems have that level of guarantee on the StarFire E15000s. Subject to a site survey. And of course, if you're prepared to pay 15 million or so for the hardware.
If you want a higher service level than YOU SIGNED A CONTRACT for, then I'm sure CCP will be more than happy to oblige. Provided you're prepared to cover the increased overhead of course.

Statutory rights would only be relevant if the product was unfit for the purpose for which it was sold.
In this case the product you bought was the right to access the game server using the supplied software subject to the server being avaliable. A one month subscription gives you the right to log-in and play anytime during the month that the server happens to be up. It does not give you the right to be able to play 23/7 for the entire month.
Now, CCP states that they will take all reasonable measures to ensure the server remains avaliable, but make no guarantees about what level of uptime that will result in. The only way they could breach this is if they willfully ignored the server being down and deliberately made no effort to fix it. As long as they are making a reasonable effort,even if the problem takes a week to fix, they have not broken the agreement. Of course, in that situation they may well make a refund to maintain goodwill, but they are not contractually obliged to.

ok I wont point you to my original reply where I stated that I was not having a go, and that I simply docked for the unexpected downtime, and that I wasnt bothered.. as things like this happen.
Just thought that the disclaimer is an interesting point.
Did I mention I wasnt having a go ? I must have missed that bit out due to the whiners who feel it is their duty to jump on every post.
I will happily continue to pay my monthly subcription, and take any little downtime in my stride.
Oh, and Im not having a go... CCP can disclaim away, take away my consumer rights and money and I will stay pay, play and be happy. 
you guys are very easy to wind up you know.

Having read CCP's forms, these are pretty vanilla. When you clicked yes, you signed a contract and accepted ALL the terms and provisions of use, whether you read them at the time or not. This includes the waiver of CCP's responsibility for downtime.
After this point, CCP needs to take all reasonable steps to provide the contracted service. Reasonableness would be determined by the type of service CCP was providing, the amount you were paying, whether the loss of service would result in material harm( financial or physical), the standard of care taken in the gaming industry etc ....
The Judge would also look at whether your expectations were reasonable. Further, since this is Contracts and not Tort law. If you knew you would suffer some unusual loss from loss of service, he/she would expect you to self-insure to mitigate damage. IE, Find another game to play in the meantime.
So to conclude, they aren't keeping your life support running and for 15 a month, you can't expect it. I hear there is a new version of America's Army out. You could play that during downtime.

I can tell you don't have a clue what it is ccp does, how the network and cluster work, and have had your head buried in the sand to avoid the news about OS's having buggs and flaws that cause unexpected issues with those using them...now pull your head out (of the sand) and get some caffiene, a doughnut, watch the news for a bit and relax, it is just a game!

Can you not understand that.. I think its plain enough.. I will try again.
I am happy with CCP, the product and the service, I do not care that the server was unavailable for longer than the normal downtime. Things like this happen (Im sure I said excactly that some time earlier) and I am sure that it was out of CCP's control, and that they did everything possible to ensure it was back as soon as possible.
Dont feel the need to quote the Eula, or how it may or may not relate to statuatory consumer rights in the UK.
I really dont mind.. please try and understand and get of your soap boxes.
