The high points though somebody is being prosecuted in US Federal Court for using a fake identity to get access to a non-financial website (in this case a fake Myspace profile). Old story bad facts make for bad law but if you're running a major corp or an alliance you're going to want to follow this (as the eventual outcome might include the question, is spying on somebodies EvE forum a violation of federal law).

I do live in the U.S. but i am not a citizen. I am Cuban. TBH its not a matter of sensitivity but more of an issue with people making comments based on ignorance. While Americans tend to be the 1st ones to make ignorant comments about just everything beyond their borders it doesn't make it better for anyone else to do so as well. I try to take an impartial view no matter what the situation. This woman iirc, set up a false account in some one elses name whom, she had a personal vendetta against. She used pictures of the victim and posted all kinds of slanderous things.
This has to do with fraud and slander. Signing up for someone internets spaceship forum does not entail the same thing as making a fake myspace page for you neighbor, filling it out with her info and pictures, and saying she likes group sex and BDSM or some crazy shit.
Also, part of the Terms & Agreements for signing up a myspace profile, specifically says that fraudulent use will be prosecuted. If you put something like this in a clause in the T&A for your forums, then you would have a way to legally prosecute some one for spying. Highly doubt it would be worth even pursuing tho, Cuz really youd just look like a jack ass on CNN

So if someone were to start a web-page that earned revenue via advertising and relied on their character's in-game reputation in order for people to trust their service (and thus provide them with the traffic needed for advertising revenue), it wouldn't be libel if someone somehow impersonated them for the purpose of assasinating their reputation and by doing so cause irreprible harm to their business?
I'm not saying it would, but its probably enough to land the person who committed the offense in a civil court if not a criminal one.  --

After a search i found a little more detail. This woman Lori, The defendant, Fradulently signed up a myspace account with the intent to cause emotional harm to the victim (megan). She incited many vulger lies about this young girl. And eventually it go to the point where Lori posted "The World Would be a better place with out you"
After that message the girl Hung her self.
I think ALL of you are missing the bigger point.

As someone who's spent a good time in court as a defendant in my past, I can promise you this NEVER crossed my mind. Things that DID cross my mind were: Is he a jerk by nature? Is he in a bad mood? Is my lawyer and idiot? Is my lawyer in a good mood? How much of a ***** is this PA? How many of the people in this room are deciding the fate of my future, and are total idiots?
Their political affiliations rarely are taken into account at any time other than the Supreme Court. But thats a moot point, as most laws are originally made by...hold on, this is the amazing part: Democrats and Republicans.

Not to nitpick, but I think David Souter and probably Anthony Kennedy are both judges who have upheld Roe vs Wade despite being appointed by the Old Bush and Reagan respectively. And former Justice Sandra Day O'Conner was also appointed by Reagan and I think she supported Roe vs Wade as well.

If you use the internet to cause real world harm, yes it is a crime, as it should be. I would imagine it would be in the UK, Australia and Canada as well, the UK especially due to stringent defamation of character laws. On the civil side, I would expect the UK to actually have stronger laws than the US. I don't know about the rest of Europe or Russia.

That said, yes you could argue that USA law prohibits such attacks. However the computer hosting said site would most likely have to be within the confines of the United States or her territories.
Furthermore you would have to establish that you suffered a quantitative loss in regards to the hacking. This is difficult to prove when a site's sole purpose is for a gathering place for a game. It probably would be hard to meet this requirement.
To Jas Dor, EVE's TOS and the EULA cannot make legal what is illegal. That's why so many EULA are thrown out not only in US Court but EU courts as well.

Laws are man-made so they are not perfect in nature. The U.S. may have some very idiotic laws, but before you go spewing nonsense about things you don't understand do try and look at your own country's amazing justice system.
While I wouldn't be using Russia as an example of justice being done, the US certainly doesn't have much integrity in that regard considering the politcal nature of their highest court (which has supreme authority over everything in the country).
When a democratic president appoints a judge that is anti-roe v. wade or a republican appoints one that's pro, I'll shut up, but until then; the only thing America can say is that it's good at hiding the biased nature of its justice system (how does a registered democrat feel about having a case tried by judge who was elected as a republican representitive?)
Not to nitpick, but I think David Souter and probably Anthony Kennedy are both judges who have upheld Roe vs Wade despite being appointed by the Old Bush and Reagan respectively. And former Justice Sandra Day O'Conner was also appointed by Reagan and I think she supported Roe vs Wade as well.
Actually I have to admit that I spaced and thought Clinton had appointed O'Conner, but nonetheless I was talking about contemporary and future apointements (if you read what I wrote), and my point still stands: those judges may have been part of "pro" or "anti" decisions (there was a time or NY times article recently where supreme court justices admitted to 'politicking' on the bench) but in terms of their views (which they openly state during the confirmation process) given the current political climate; it is unlikely you will see a suprising appointment regardless of who wins the upcoming election.
And if you think that John Roberts was appointed as a pro-Roe v. Wade judge then Yes I'll shut up because the discussion would be lost on the ignorant.....

I agree America is moving into facism with the criminals who have our country hyjacked, but
Obama is far from any answer. He is Bush AND Cheneys COUSIN.
