A friend of mine gave me his eve account to play a few months ago. I've dont just that. Been playing the account and making it better and have updated all info my my credit card and have been paying for months etc. NOW he claims he wants to get back into eve again, and wants the account back. So he petitioned to have CCP give it back to him. WTF? Will ccp give this account back just because he had it first? Please help.

Accounts are non transferable. As the 'true' owner of the account your friend, within the EULA, will get it back. But that said by giving the account for your to use I'm sure he broke the EULA as well, so probably a ban for him.
But I'm sure if this was take to the pure letter of the law. ___________________

Well, posts like this are hard to prove. If what you say is true, I doubt CCP will give it back to him. It will have your credit card billing information and show that you've been paying for the monthly fee. If he wants back all he has to do is make a new trail account and then update it after 14 days and he's out only $20. Give him $20 and tell him to get over it. He's probably just wanting a character that he doesn't have work hard on. You might even petition and state that he gave the account to you and you have been paying for the monthly fees. CCP has 2 options;
- Since they don't allow for account tranfers they just don't recognise the whole transaction and will call home to mama (in this case, the original owner) and give him access to the account.
- Since they don't allow for account transfers the question of who has 'right of use' of the account is simply moot, the account was used in an action which breaches the EULA and is therefore banned.
The chance of you keeping the account are almost zero.

This happened to a friend of mine a month or so ago.
He'd been playing eve from the start, and left after about a year.
He came back to Eve about a month or so ago and found that his account had been hacked, and that someone else had been playing the character (and paying to play it) up until the current date.
After a fair amount of communications between my friend and CCP, the decision was that while he could have his account name back, he could not have the actual character... which to this day remains in the possession of the one who stole it.

One more possibility (and it doesn't sound like this is the case): If what he wants is the account or another character on the account, and what you want is the character you've been playing, you could open a new account and he could do a character transfer.
This would make both parties happy while allowing CCP to stay out of it.
But it sounds like you both might be wanting the same character ;p

This account was not hacked or stolen but given to me by my friend who now wants it back. I really do hope the side with me in his petition as he gave it to em willingly. Thanks alot for your advice and answers.

Out of curiosity, how is he petitioning? Don't you need to sign in with an account to petition? You did change the password when you updated your credit card info, right?

CCP need to make new ruleą simple one would beą that the person who has paid the most on that account as per credit card info would get the accountą simple as that just a simple rule stating that if you informally give someone your account and that person has used and paid for that account more then the original account holder that they are then the owner of said accountą I think this is for the best interest as the person who is paying clearly is showing interest in EVE while the person who left and gave it up really doesnĘt have and might quit again and leave the account abandoned or sell it for isk/money or some siteą
IĘm in favor of that person who is paying and is interested in the gameą thatĘs what CCP should vote for as well.

I'm pretty sure that authentication will be done, not by credit card, but by the email address the account was first attributed to/made by.

If a person bought eve accountą played for say 3 monthsą sees he doesnĘt like itą gives said account to friendą that friend pays and invests over 1-3 years into that accountą and then the original player comes in and wants it back? I think you could probably even win in court that the person who has invested and paid for said account, pretty much CCP is playing judge and not very good at it, and by there rules atm would be favoring just the person who has bought initial boxą mind you that initial box + 3 months is < then someone who has paid for account for 1-3 years? If anything rule should be to own account you must have paid for it greater then initial cost of (box) + the monthly fee of said owner to get the account.
What do you guys think :P if this was not a MMO and not a monthly fee then it would go for the Box owner of courseą as other friend who has account did not invest any real money into it.

As others said, I'd transfer the char then give it back. I would've done this in the first place and then not subscribed to the old account because account transfers arent allowed. Technically he is still the owner, but for letting somebody else use it, he has breached the EULA.

are we talking here accounts with characters? or just account? or character because thats a whole diff story... if person wants account... then hey give it to him it might cost you $20 for char transfer but you get to keep that char that you have invested in and they can have there account and create a new one 
quite frankly people are lucky the chars dont expire or get deleted... so i dont see why ppl who have left would complain or demand accounts back... esp when they can change the story around very easy... if it was just verbal.

If he actually said "OK, you can HAVE it", not "ok you can use my account for a bit, but I want it back if I ask" he shouldn't be asking for it back, he gave it with the understanding that it would be his, which is why the new owner invested time into it. If I'm wrong, say so, but if you give somebody a gift, and then ask for it back, thats kind've rude and doesn't make you a very good friend.

The way i see it there isn't much difference from him giving you the best present of your life, then taking it back an hour later when your having the most fun "cause he wants it". Doesn't sound like much of a friend to me . But worse is that the account may very well jsut get banned .

QUICK, transfer chars before it happened. Also delete any trace of posts here. And then, make a new character on the old account and say you deleted his/your character and wanted to start over. Then give the account back

He won't get it back, and chances are high on you getting banned. No account transfering is allowed. Exactly for this reason. Should have had the character transfered

This happened to me about 14 months ago, also with exactly the same outcome. Annoying bit was while I was away they added the character transfer function and they sold my 20mill+ SP char for loads of ISK and I had to start over.
Annoying, but at least they appear to be consistent which is good.

Make a new account yourself RIGHT NOW! and transfer your stuff over to it.

Account sharing (i.e. allowing anyone but the original account owner to use it) is a breach of the EULA. Whoever should get the account back on ethical grounds will just have a banned login to play with.

If account transfer is against the rules, how come its possible to modify the account information, including Name and Gender?
Surely the safest way to ensure this would be to lock that information upon account creation, and then in the cases of players changing name or undergoing gender realignment, they can appeal to have their information changed.

see, most other games do not alow the trade of accounts, and so in such a case, the original owner would be given his account back. i know where i used to work (on a rival mmo - no i will not say which one for security reasons, so don't ask) I was head of a team who dealt with accounts that were both stolen and traded, tracking down the main account of the "thief" and banning that account if it had interacted with the stolen one. just think yourself lucky that the worst that will happen with CCP is that your friend will get his account back.
i don't mean to sound harsh, just looking from an objective point of view, and i know it may suck to loose your work, however it was your friend's work in the first place. you want an account, i believe you should work for it, and all those who buy accounts are not getting the full game experience (and are at least a little bit lame for doing so). ========================================== Iy |

If he gets it back, petition to get him banned, if he doesn't, rock on You could always start up a new account, transfer the character to it, then give the old account back to your mate, but then I'm guessing that will start all sorts of problems out... If say this person has been playing the game for 2 years, he has been paying for the actual game and has payed the monthly fees after that. If this person after you have played it a few months reconsidered and wanted it back, ofcourse you let him have it back. What kind of friendship is this really, we are talking a toon here. + What you have paid for a few months is the payment for playing the game, its not like you have invested 1000 $ on it ?. Ofcourse if you had played the game more than him, and the char was built mainly by you things would be differently.
Keep the friendship and try to agree on some isk if you feel that you have contributed much. Not giving this char back is crazy if you are talking friends or people you know here.
Maybe try to agree on something rather that petitioning one another. Sounds crazy to me.

Dont forget to pod selfdestruct the character without a clone over and over again to bring the SP down to where it was when he gave it to you

Are you sure it is really him petitioning?
If the answers are no and yes then I would:
1) create an alt called youreanidiot or somesuch 2) Sell the main for isk 3) create a new account 4) transfer the isk to your new account 5) let your friend reclaim the remains of the account, consisting of one character called youreanidiot
But be creative. Don't do this, nor exactly what anyone else is saying. Personalise it.

CCP will ask for the name, birthday, registration key, registered name, and various names of charecters possibly on the account in order to confirm that they are the origional owner. Once this is confirmed, the account is rightfully his because the EULA clearly states no account transfers and no sharing login stuff. He will have the account returned to his name at the very least, and at the most will also have the account banned for breaching the EULA in several places. Any charecter transfer attempts would most likely look maicious in the face of the petition, and will likely result in the OP getting an IP ban for selling/moving a charecter not rightfully his, which in the case of an isk sale would amount to scamming people in one of the few ways they would actually interfere.
I know all this because a few months back someone got into my alt account, sold it on ebay with a 90 day time card, and then changed the password and everything after it sold and the buyer had logged onto the account. CCP was slow on the resolution (36 hours iirc) because of all the confirmation they had to do (also comparing ip addresses) but in the end they did what was right according to the EULA (and i got to keep the timecard \o/ ).
So unfortunately, the OP and quite possibly his friend too, are out of luck. you should have done a charecter transfer instead of an account transfer, and then the charecter(s) would legally belong to the OP. Sorry man. --------------

To be honest CCP's position on this is ******* stupid, and theres no way the account should be banned. Yes I know they broke the EULA but to be honest **** off. Its a stupid rule in a lot of cases.
Get your friend to cancel his petition, Inform him his petition is just going to get himself banned anyway.
Then agree to iether Transfer the charachter to a new account and you pay your mate for the transfer in ISK if you can afford to do so. Win Win situation.

And like DS said ... it probably won't be. CCP have the RIGHT to ban you for breaching the EULA. They don't automatically do so in every single instance; they can do whatever they feel is appropriate. ________________________________________________

Sounds like your "friend" is a worthless pile of dog ****. View the incident as a "learning experience".
For the record, in ANY game, if you get account from a friend, ask point blank "Am I simply "holding" this account, or is it MINE?" Get that question settled before investing in it. As for the EULA, you will lose the account.

Look at the situation as it is. Your friend has created the account with his name, date of birth, email adress etc.
Its still his account, he gave it to you to "play" with it. Now he wants it back, and when you did¦nt create an own account and transferred the character you build up to it, its your fault.
That¦s the difference between an account and a character. The character is your work, but not your property* as long its not your account. So ffs transfer it to a new account with Vmax and give the account back to your "friend".
An other possibility would be to tell your friend to give you the money back you invested into the character, this doesn¦t give you the time you needed to build your toon, but you can use it to build up another char.
Btw, I think after the mods have read through this thread, the account will be banned, so its not that important.
Kids, please read the EULA and think about what you are doing!
*the character is still the property of CCP, but you have the right to use it in EVE when its your account :)

Sell the char for isk and split it, both of you can start a new char with plenty of isk in your wallets and hopefully we will have all learned something from this. |

If someone willingly gives their account details to another person they have effectively given up all rights to that account. This is basically what I was told by GM's during a similar incident to yours.
If CCP do in fact give the account back to its original owner I would be extremely interested in their reasons why.... and more importantly want to know why they have one rule for one person and another rule for another person when both instances are pretty much identical (from what I've read).

I honestly think CCP could just ban the account if it was given away after account giving/sharing was made against the EULA.
That way, you two don't have to risk your friendship over a friggin game, and CCP can enforce their rules.
