the whole 'button click is legally binding' thing is just begging a test case.

LOL at everyone saying EULA EULA!
First of all, they rarely hold up in court. Second of all, the EULA does not protect CCP in this circumstance, because the EULA, was only displayed after EVE was installed, since after installing the update screwd the game up, the EULA means nothing, and CCP is 100% liable.

Edited by: Major Death on 10/12/2007 10:21:30 Its CCPs fault. They didn't test the update properly, and as a result it caused dammage to customers PC's. As for the EULA claims, local law will over rule the EULA as when it sees fit.
However CCP are an Icelandic company, so any action would really need to be taken in Iceland, where trial by combat is still legal...
My original sig was 'Enjoy lag free play in a dynamic space MMORPG'. It was removed for lack of EVE content! ;) CCP say 'Shut up about bugs and eat your eye candy!' |

You are also a moron. this is not about accidental falling. It is about deliberate deletion of a file that does not or has been licensed by CCP which would be the BOOT.INI file. By law they are not allowed to modify it without a license from Microsoft.
Calling people names or insulting them wont get you anywhere, gotta love the manners for a 18+ game.
Do you REALLY think CCP wanted to delete everyones C:\BOOT.INI on purpose? heh, aight. "Worlds first Game with imbedded virus!"
Seriously, this was not a deliberate action by CCP, it was a malfunction of the programmed code as it wasnt thoroughly tested with all the possible client setups out there (considering it only affected a percentage of the gamers, therefore this scenario wasnt tested).
You cant prove they did this on purpose, who would think such a thing anyway?
It is easy for you to sit there like THE VEIN, SELF CENTERED, A**HOLE YOU ARE because you were not effected by this. There are some really angry people out there. I suspect if you were really effected by this calamity you would be talking a different game. I can tell because you only like to hear yourself talk and you don't listen because you are a F***ING M***N. So F***Y** and the horse you rode in on.

Yes, an international company can be sued in any country as long as they do buisness there. That is, if CCP operate any offices in the US (say a little company called white wolf), they are subject to us law

^ Only link I could find in a few minutes
Quote: and what harm did it do?, nobody lost anything. you could just insert your original cd, or a bootdisk, a live cd with linux, or repair windows. and its not like they didnt warn people as soon as they saw the problem.. if you lost some work, you only have your self to blame.
Only if you know what you're doing. Fairly poor analogy, but look at it this way. If you pay me to wash your car, and I just happen to take the spark plugs out, are you going to be able to diagnose the problem yourself or are you going to need to take it to the shop? It'd take maybe 20 minutes for you to fix. If you knew how. If you didn't it'd probably cost you $200 at your local garage. After all, by your logic, if you didn't see it coming or know how to fix it, you have only yourself to blame
Also, to the guy quoting the eula- whether or not they're legally binding is a whole other matter, and don't cover you in cases of gross negligence in either case
First off: if I went to a car wash that wanted me to sign terms of use, I wouldn't do business with them.
Second: what business does the car wash have under my good unless I give them consent to wash my engine or something?

One slight problem with that, the bug left your PC unbootable. So if that was your only PC then good luck.

It might be more fun to take a suit out against Microsoft for not providing protection from this happening. By not doing so they made it possible for the OS I paid for, from them, to be rendered inoperable by a simple command which is part of that said OS - with no warning.

Sorry, I discussed point one in my original post- Terms of service and eula's do not provide a defence against negligence. Just because a company says "all care but no responsibility" doesn't mean they can actually cause you damage without any problem

I have read the EULA and it would not stand up in court because it does not state which licences it has beyond the software you are using. "SYSTEM" is vague. no license, no case, so F*** Y**. and ten years later you get your 40 euros back.

You started downloading the upgrade from Trinity Classic Graphics Content to Premium Graphics Content BEFORE 04:00 GMT on Dec 6 You must be using a version of Windows other than Vista. You must have Windows installed not on the primary partition.or You must have at least 2 hard disks and the OS must be installed NOT on the primary, but the secondary hard disk.
If u meet all of these you are a Arrrtard. Thanks for playing the internet game, you lose.
