There is a very large fallacy in your argumentation....
I'll even provide an example: If I have a flat tire on my car (meaning I can't drive it), the car manufacturer is not financially responsible if I don't know how to change a tire, and instead order a complete replacement of every single little piece of the car except the chassis.
Similarly, CCP is not in any way responsible for peoples stupidity, no matter how many offices they might have where!
The boot.ini problem was utterly easy to solve, and if anyone lost data or reformatted their harddrive, it was because they did it themselves.
CCP's patch deleted ONE, easily restorable, file! Within a couple of hours, there was detailed instructions made available on how to fix the problem.
So please, stop playing lawyer, because you utterly fail at it!

The EULA most likely wouldn't protect them from the gross negligence of deleting a boot.ini file.
However unless you spent money fixing the problem yourself such as calling Geek Squad, or another computer technical service which charged you for the service, you are going to have a very hard time proving that you suffered any meaningful loss.
Thus to sue you'd have to prove an economic loss (such as that by paying a technical corp to fix your computer). Otherwise you would not be eligible to sue. It doesn't matter whether the loss occurred before or after CCPs announcement since you may not have received the announcement, after all they didn't email me about it despite having my email address.
The next problem would then be getting the thing into class action, which is not always easy. Since the entire player base cannot meet the economic loss test, then it would be much harder to sue on a broad class action platform.
If several people started individual lawsuits in the same jurisdiction, then it is possible that a judge might consolidate them into one case, but that is not the same as a class action.

I also 100% agree with the OP ... that the EULA means NOTHING and that you could sue... also that there isn't a wet chance in hell you would get anything worth while.
In most places EULA's aren't worth the time they take to type ... I wish they were ... but there not.
I wasn't affected by this hick up ... and i think it speaks badly of CCP that it even happened .. but there is FARK all you can do about it next to whinging which seems pretty high on some peoples minds.

If the case goes to Iceland and trial by combat is allowed, I will sue CCP just so I can challenge the CEO of CCP to trial by combat with a Nerf Bat and/or Silly String, with left hands lashed together. @ Major Death, true enough but as already stated, in this day and age, a computer is generally a small leap away. In my case i have a few PC's at home which i could have used, else i could have checked the forums at work, a library or the McDonalds down the road. Or i would have fixed it myself as i do know something about computers and the effects of a missing boot.ini ;) But point taken, clevermonkey might be living in a Development Country and he's the only guy with a PC in a 100km radius.

Indeed, even though the deletion of the file was purely accidental, CCP are guilty of negligence.
