CCP holds an office in Georgia which is in the United States. Therefore they are actionable for a class action suit to all players who have attained losses due to the BOOTINI incident. CCP's EULA does not cover windows operating systems and therefore they are again actionable for loses. CCP's EULA is very thorough, however they do not control licences for Microsoft and cannot deploy a EULA under those circumstances. Remember this. If you bring suit against CCP you will have to forfeit your term of use. You will never be able to register another CCP game again. you will have to quit your current subscription. After ten years of litigation you will get close to nothing. CCP wins. It is the Law.
*sigh*
Well done, yes you're clearly right. Thank you for pointing this out to me and making my life more complete. Thanks to your insight I am now a happier and more fullfilled person. Just one question...
What is your point?

Having an office somewhere does not bind your entire company to that countries laws, that's just stupid, and if it did, CCP would just close the office if it could be used against them.
You're right, they can kill each other (as long as it''s in their bank) and wont get arrested by the US, they're complitly immune to the US's laws.
what great logic this is

On the 'toughen up' part....
Which country is it that has crybabies wearing kevlar body-armor while playing rugby???? And which country is it that consider 'Rounders' to be a sport for grown-ups???

I've fought alongside US troops and my friends have - some got injured, some died. What I do know is that both the US troops I worked with, and the UK troops had the utmost respect for each other. Both seemed pretty tough to me - neither would have much respect for your point of view however.

oh legal scholar, maybe go to the university of pheonix or some law office in walmart, but i am pretty sure that when an entity does buisness, ESPECIALLY, has a physical presense, they maybe taken to court. Now whether the litigation of the entity is contrary or poses a difficutly for the department of state and or the US gov is another question. Since i dont think GWB could even type on a keyboard, filing against CCP probably wouldn't catch anyones attention

I guess by the 40,499 players online last night that a lot of people are still throwing their toys out of the pram!
Does anyone know if that is the record by the way?

Before thinking about a lawsuit you should come up with a way to proof that CCP is responsible for the deletion of the boot.ini and not something else. I mean maybe you deleted it yourself in order to be able to launch the lawsuit to begin with....

Anyone who thinks they can take CCP to court is absolutely correct. There is a case and it would be presented. It's most unlikely you would win however and it wouldn't be cheap. I'm betting CCP have more funds for lawyers than most of us.
A simple letter to CCP stating your issues, the inconvenience caused and a copy of any invoice incurred for fixing your PC would suffice. Give them a reasonable amount of time to get back to you, say ten days, and state what you will do after this time period. Most company's will pay out on a goodwill basis thus avoiding any court action.
If they don't get back to you, notify trading standards who as a matter of course will contact CCP with your concerns. If this doesn't scare them into paying your PC bill then go to BBC Watchdog and register a complaint with them. No doubt mentioning this affected thoudands of people will spark their interest, you might even get on the TV

Ever tried to install AMD Dual Core Fix ? Well a friend of mine found that on the support page of a game, that crashed on his system, which did not even have a dual core amd. It let him install that anyways and he had no clue. One of that AMD patches anyways added something to boot.ini that caused the system to boot up from then on with hal.dll error bluescreen.
While it is a bit different here of course, don't see why there should be any data lost. Formatted drives happened solely because people chose to format their hard drives, just as my friend chose to install a program not suited for his system. Also this was not a necessary update to your business system that needed to be applied during your business hours. So if people choose to not protect their data in any way and then decide themselves to wipe it clean, a boot error is responsible for that ?

"Never in the Field of Human conflict have so many Dummies been spat by so many, to so little effect."
First off EULA's are enforceable to quite a large degree even in the US. The Urban Legend that they arent, is rubbish.
The lack of enforceability of EULA's relate to how well they have been read and understood by the Customer and to their accessability before buying/signing it.
For someone who has played EVE for a number of years and clicked through the EULA agreement a number of times any claim that you didnt understand it would be laughed out of court.
Second factor is that in respect to Trinity it is actually FREEWARE, you accept its contents "as is".
Caveat Emptor!!!
