I am not an attorney but I have attended law school and here is my 2 cents...
I think that CCP satisfies minimum contacts based on operating in Georgia.
However, I do not think that enough people could be included to get this "certified" as class action suit. Also, if it was certified then everyone residing the in US would be part of the suit if they had been harmed...you have to "opt out" of a class action suit...if you don't you cannot later bring an independent claim.
I agree with the previous posts that indicate the EULA is likely not worth the electricity it took to type it up. Given that in the past these types of terms of service have not held up and I also think that the person who said that the EULA does not show up until after you have installed the software might have a valid point. Only a court can decide if the EULA carries any weight. I can tell you that it means little that it cites Icelandic Law...until, of course, it has been given credence by a US court...should the class action suit be initiated in the US. If you do business in the US and have minimum contacts then most courts will consider that you have agreed to be judged under US Law.
The question I am curious about is...could it be claimed that it was reasonably foreseeable that the boot.ini could have been corrupted. I notice that some people indicated that there was no intent on the part of CCP and I agree...but could several computer experts be found to give expert testimony that it was reasonably foreseeable that the boot.ini file could have been corrupted?
Perhaps then it could be claimed that CCP was did not have the expertise to be handling such a patch deployemnt and therefore were negligent. You can claim negligence when your property is harmed, providing "data loss" is considered "property damage" then...
Negligence requires
* 1 Duty of care
Did CCP have a duty of care to its subscribers (who could no longer play the game they had paid for w/o downloading the patch)?
* 2 Breach of duty
Did CCP breach that duty by offering the Trinity patch?
* 3 Factual causation
Did the patch materially increase the risk of harm to the subscribers boot.ini file? Did CCP through a particular acts or omission cause the loss or damage sustained, in this case a corrupted boot.ini file. This may have resulted in other data loss (not sure if this other loss is relevant , it might not be)
* 4 Legal causation/Remoteness/Causal Proximity
Was the harm caused to users too remote for CCP to be blamed? I don't know how an attorney could show causal proximity...ie "sufficient proximity" to damaged property...unless downloading a patch and having the code on your system is considered proximate enough...if anyone has any ideas on this I would love to hear them :)
Also to show proximate cause you need to show that it would have been reasonably foreseeable for the harm to have been caused. I think in this case you might be able to get enough experts to say that a patch such as this might have that kind of effect on the boot.ini file.
* 5 Damage
Did actual damages result from CCP's actions. Even if all the above is true and CCP is found guilty of 1-4 if there are no actual damages then there is no successful claim for negligence. Typically if damages are proven (and they must be for a successful claim) then the claimant must be compensated. Damages must usually be in loss of reputation, financial loss, physical harm. Now in the US sometimes punitive damages can be given out but usually it is just compensatory. Not sure how you would go about quantifying damages for a boot.ini corruption but anyway...
in the end... IF CCP was found to be negligent 1. the attorneys would walk away with tons of $$$ 2. the class action claimants would get next to nothing 3. CCP would go out of business and 4. the rest of the EVE community would be very very upset with the original "Lead Plaintiffs"...

I wasn't affected by the patch (since i've still not downloaded the new graphics yet). I'll say now that I think legal action is probably a little excessive, but I do understand why people are annoyed by this.
What baffles me most by all of this is the players/trolls posting here that other players (or entire countries) are stupid because of a grave error made by CCP.
Sure, people make mistakes, CCP made a big mistake (relative to patch errors). Whether it deserves legal action will ultimately be upto those affected - end of story, but it was a result of some very poor testing of a product that was distributed to tens of thousands of user accounts.
Ultimately CCP are accountable for damaging peoples computers (regardless of how easy or hard it is for some to fix it), and because of this, people have a right to feel annoyed or angry by a company they trust.
Regardless of what any EULA says and legalities. Would anyone of sane mind downloaded the content patch if they were told in advance that doing so would make their operating system unusable? of course not.
I'd feel pretty annoyed if my phone company downloaded a content upgrade to my cellphone and made it unusable and thats worth less than my PC, so i'd imagine i'd feel pretty peeved if my computer had been rendered useless.
The end user isn't to blame because of this, nor is the end user 'stupid' because they took their computer to get repaired. Not everyone is computer literate (just like not everyone is a mechanic or electrician).
People have a right to be upset and are not being unreasonable at being annoyed that CCP damaged their Operating System.

If you put it under pressure it will boil at a higher boiling temperature. Add more heat and it will just boil faster, not get hotter.
Note that the OQ didn't say "heat water above 100C" or summat. ----- TANSTAAFL

You're better off suing Microsoft for making an operating system that allows itself to be corrupted by the applications it runs.
Why would a system configuration file be adjustable or deletable by a simple application without the user explicitly stating they are OK with that?

I'm assuming because this thread is still going no one has had the bottle to sue yet or even seek legal advice. These people don't want to sue, they're just doing the human nature thing, whine and posture to get it out of their system.
Rather then tell the community why don't you get you Lawyer to send a letter to CCP. Feel free to post that on the forum that would be interesting instead of pretending to threaten to sue.

it was a big *(^& up i agree. eve technically became a destructive virus. but it wasn't malicious. just a big *(^& up
loads of people are not computer literate enough to be able to solve that kind of issue, which is fair enough.. and they may have not been able to solve it by checking the forum (due the fact that maybe (for instance) only had the one computer)
but give a ccp a chance to make it better. let them this busy time end and then let's see what they can do for you
we knew the patch was coming and we knew there will be problems. the problems are being addressed, slowly perhaps but they are.
if you are so angry you dont want to play anymore, fine. stop playing, send me your stuff, close your account, leave the forums alone and take whatever action you want!

Boil water. Collect steam and put under pressure. Heat steam.
Heated steam under pressure = water heated > boiling point (because it has already boiled at a lower temperature to produce the steam.)
The guy is right when he suggests superheating the steam. (Unless you are going to argue that steam is not water?)
